4.4 Complaint – Verbal or written communication alleging a City employee has harassed and/or discriminated against someone based on a protected status, or who has engaged in behaviors that meet the definition of bullying. The person alleging the complaint is known as the Complainant. 4.5 Discrimination – The unfair or prejudicial treatment of a person or group based on their protected status as listed above. 4.6 GSOCARES – An online and telephone reporting system for employees to report violations of policy, ethics, laws, and safety. Employees can report alleged violations and remain anonymous if they choose. 4.7 Harassment – Harassment is a form of employment discrimination that includes unwelcome conduct based on a person’s protected status. Harassment becomes unlawful where: A. Enduring the offensive conduct becomes a condition of continued employment; or B. The conduct is severe or pervasive enough to create a work environment that a reasonable person would consider intimidating, hostile, or abusive. 4.8 Hostile Work Environment – A hostile work environment occurs when comments, conduct or actions (harassment behaviors) of another are so severe or pervasive that they create an unwelcome, intimidating and abusive work environment based on a person’s protected status. 4.9 Ostracism – The action of intentionally not including someone in a social group or activity. Ostracism can be a characteristic of bullying. 4.10 Respondent – Person against whom the complaint is made, also known as the accused. 4.11 Retaliation – Punishment of an employee by an employer (either directly or by the actions of a manager, supervisor, or administrator) for engaging in legally protected activity such as filing a complaint alleging a violation of this policy or participating in workplace investigations. Retaliation can include disciplinary action, up to and including dismissal, refusal to hire or promote, salary reduction, job or shift reassignment and/or other actions affecting employment such as threats, unjustified negative evaluations, unjustified negative references or increased surveillance. 4.12 Sexual Harassment – Sexual harassment is a form of discrimination and includes unwelcome sexual advances, requests for sexual favors, and other conduct of a sexual nature based on a protected status such as gender or sex (see definitions of harassment and hostile work environment above).
