Employee Demotion Number: D-10 Revision: 6 Effective Date: 01-01-2018 1.0 POLICY C ertain disciplinary actions may result in a demotion of an employee to a position assigned to a lesser control point and/or a lesser salary. 2.0 PURPOSE T o provide an opportunity for an employee who is not able to adequately perform in one role to acceptably perform in a lesser role. Demotions may be used in lieu of termination. 3.0 SCOPE This policy applies to all benefit eligible employees. 4.0 DEFINITIONS 4.1 Benefit Eligible - Full time and part time employees who are eligible for coverage and participation in the City’s benefit programs in addition to legally mandated coverage. See the appendix document, Position Types on page 424. 4.2 Demotion - The movement of an employee from a position in one job classification to a position in another job classification assigned to a lesser control point as the result of discreditable circumstances. 4.3 Control Point - The job value the City is willing and able to pay. The control point is based on the market value of jobs and internal value to the organization. The control point is the basis for most salary administration calculations. 5.0 ORGANIZATIONAL RULES 5.1 Demotions will always require a decrease in the employee’s salary of a minimum of 10%. 5.2 The salary of a demoted employee will be reduced a minimum of 10%, as long as the resulting salary is within the salary range of the new position. However, if the resulting salary of a demoted employee exceeds the range maximum for the new position, the employee’s salary will be reduced to the range maximum. For example, an employee earning $40,000 would normally receive a pay reduction of $4,000 (10%) resulting in a new salary of $36,000. However, if that employee is demoted to a position with a range maximum of $32,000, then the employee’s new salary must be reduced to $32,000 resulting in a pay decrease of 20%. 5.3 In some disciplinary actions, an employee may not be separated from the position currently occupied and placed in a position assigned to a lesser control point if no such position exists.
