Table of Contents A B C D E F H I J K L TableofContents G B. An employee may not use donated leave for an injury by accident or illness sustained while engaged in outside employment. See the Outside Employment policy on page 50 in Section B. C. Any use of donated leave must have the prior approval of the human resources director to ensure equity and consistency of application. D. Donated leave will not be granted to an employee who has abused his own sick or sick- family leave. E. Donated leave will not be granted if there is no reasonable expectation that the employee receiving the leave will recover and return to work. F. Donated leave received qualifies for the 12-week FMLA entitlement. The time granted and the FMLA entitlement will run concurrently. See the Family and Medical Leave Act (FMLA) policy on page 203. 5.2 Employees Donating Leave A. Benefit eligible employees may voluntarily donate earned annual leave to employees to use while they are on extended sick or sick-family leave. B. Employees may donate earned annual leave of at least four hours provided the balance of the donating employee’s annual leave is not less than 40 hours for a full time employee. Part time (PT) employees may donate earned annual leave of at least four (4) hours provided the balance of the donating PT employee is as follows: PT 20, not less than twenty (20) hours; PT 25, not less than twenty-five (25) hours; and PT 30, not less than thirty (30) hours. C. Employees may donate leave only to those employees who have been approved to receive donated leave. 5.3 Employees Receiving Donated Leave A. Any benefit eligible employee who has served the City for six months or more is eligible to receive donated leave. This leave is intended for use in situations where an employee, or an employee’s immediate family member, experiences a serious illness or injury requiring an extended treatment and/or recovery period. B. The employee receiving the donated leave must meet the following basic requirements in order for approval of this leave to occur. 1. He must, at minimum, have used all available sick leave. 2. He must have reduced his annual leave balance to 40 hours for a full time employee. Part time employees must have reduced annual leave balances as follows: PT 20, twenty (20) hours; PT 25, twenty-five (25) hours; or PT 30, thirty (30) hours.
