6.1 The Department seeking the worker should forward a completed copy of the Contract Employee Test to the People & Culture (P&C) Employee Success Partnership (ESP) for review prior to submitting a professional services contract to the Finance Department. 6.2 The Employee Success Partner will review the completed test and make a determination of whether the worker is an independent contractor or an employee using the guidance provided by the Department of Labor (DOL) and the Internal Revenue Service (IRS).
