1.0 POLICY A ll workers seeking to perform work for the City of Greensboro under a professional services contract must first be screened to determine if the worker is an independent contractor or an employee. 2.0 PURPOSE T he purpose of this policy is to ensure workers are protected under Federal Tax Law and the Fair Labor Standards Act (FLSA) by providing the minimum requirements. 3.0 SCOPE Any worker, whether individual or business, contracting to perform work under professional services contract with the City of Greensboro. 4.0 DEFINITIONS 4.1 Worker – A person who engages in providing services or a particular activity which includes manual and non-manual labor. A worker can be an Independent Contractor or an Employee. 4.2 Employee- A worker with an employment relationship with the City. In accordance with the FLSA, an employment relationship exists when the City employs the worker by allowing the employee to “suffer or permit to work.” Employees are economically dependent on the business of the employer. 4.3 Independent Contractor – A worker who is economically independent of the City. Independent Contractors are in business for themselves. 4.4 Professional Services Contract - Contracts which involve professional, technical and skilled services. 5.0 ORGANIZATIONAL RULES 5.1 A worker must be screened prior to the City entering into a Professional Services Contract to determine whether the worker is an independent contractor or an employee of the City subject to protection under the FLSA and Federal Tax Laws. A worker entering into a contract may be one of the following : an individual, a sole proprietor, a partnership, a limited liability company (LLC), a professional association (PA), or a professional corporation (PC).
