record-keeping requirements of the FLSA. 4.5 Non-Exempt Status - Employees who are subject to the minimum wage, overtime, and record-keeping provisions of the Fair Labor Standards Act (FLSA). 4.6 Service Critical - An employee whose job responsibilities require that the employee be at work regardless of weather conditions to directly provide immediate essential service to the public or provide direct leadership or support to those who do. 4.7 Flexible Work Arrangement (FWA) Employees - nonexempt and exempt employees approved to work on a remote basis. 5.0 ORGANIZATIONAL RULES 5.1 General Provisions A. The City Manager or designee will declare that the Inclement Weather Plan is in effect by announcing that City Administrative Offices will open at some time other than 8 AM and/or close at some time other than 5 PM. B. All Service Critical employees are expected to be at work at scheduled times, not at the time of a delayed opening. The scheduled time may be different than the employee’s normal work schedule. C. Employees not designated as Service Critical may, during a declared weather emergency, report to work by the opening time designated by the City Manager or leave at the early closing time designated by the City Manager and will not be charged any leave time for the day. 1. Those who do not report to work at all will be charged leave time for all hours missed during a normal work day. Employees on previously scheduled leave or who call in sick prior to designation of the closing will be charged the normal scheduled hours in leave for the day. 2. Employees (exempt and non-exempt) reporting after the starting time designated by the City Manager will be charged leave for the hours missed after the designated starting time. Employees (exempt and non-exempt) who choose to leave prior to an early closing designation of the Administrative Offices by the City Manager, or facility or program closings made by the Department Director, will be charged leave time from the time of the departure up to the early closing designated time. 3. Other (not benefit eligible, rosters) employees will be paid only for the actual hours worked. D. Flexible Work Arrangement (FWA) Employees - Non-exempt and exempt employees who have been approved to work remotely are expected to work as normal during adverse weather conditions unless the weather conditions affects their ability to work. Such reasons may be include an electricity or Internet outage. In such event, the FWA employees should
